Interpreting Services
General
Interpreters are used to assist Land and Environment Court judicial officers (Judges, Commissioners and Registrars) in Court matters:
- to ensure fair and effective court processes;
- to ensure that persons appearing before the Court can fully comprehend and effectively participate in proceedings; and
- to help ensure the proper running of all cases before the Court.
For straightforward and simple procedural enquiries made at the Court’s registry, staff can assist you by contacting an interpreter under the Community Language Allowance Scheme (CLAS). This service is subject to availability and does not extend to in-court assistance. The CLAS officer cannot give any legal advice.
If you wish to obtain legal information and assistance, call LawAccess NSW on 1300 888 529. If you require an interpreter when speaking to LawAccess in a language other than English, call the Translating and Interpreter Service (TIS) on 131 450, ask to speak to LawAccess NSW and a free and confidential interpreter will be provided.
Criminal proceedings
Parties involved in criminal proceedings (Classes 5, 6 and 7 of the Court’s jurisdiction) before the Court should contact the Court’s registry office at least 72 hours (3 days) in advance of their appearance if they require an interpreter for in-court assistance. There is no cost to the parties associated with the provision of an interpreter for criminal matters at the Court.
Civil proceedings
Parties involved in civil proceedings (Classes 1, 2, 3, and 4 of the Court’s jurisdiction) are not entitled to free interpreter in-court assistance unless ordered by a judicial officer of the Court. When making your own private arrangements for an interpreter, you are advised to contact the Community Relations Commission (CRC). Parties involved in civil proceedings are advised that the CRC has fee exemption guidelines, contact the CRC to obtain further details.
Interpreters engaged by the CRC are bound by a strict code of ethics, which requires:
- Impartiality
- Disclosure of conflicts of interests
- Confidentiality
- Accuracy
- Competence
- Honesty, integrity and dignity
- Reliability and punctuality
